Although Opal obtains information from several authentic
sources and employs a variety of sophisticated techniques
to ascertain facts relating to employers and candidates,
yet it does not guarantee that the information is
exhaustive, wholly accurate or free from human errors.
Many of the test results, including psychometric
/technical, are subject to errors of judgement or
interpretation. Opal engages the services of several
experts or professionals on a contractual or assignment
basis to conduct certain studies or investigations. It
also relies on test scores and automated responses using
software designed by international consultants. Any or all
of the above could produce erroneous reports, which may
affect the selection process. Opal has identified probable
gray areas and factored certain checks and balances. All
the same, Applicants and Employers are advised to conduct
their own due diligence or consult their Advisors and
weigh the pros and cons before arriving at any decision
with regard to the employment suggested by Opal. Opal’s
role is that of a professional advisor and the
recommendations are not binding on either the Applicant or
the Employer. Opal’s endeavor is to reduce the surprise
element in the career selection process and facilitate the
employer and the candidate to make an informed decision.
As such, Opal will not be liable for any loss or damage,
whether direct or indirect, incurred by either party or a
third party acting on information, opinion or advice from
any officer or consultant in the service of Opal.
Jurisdiction:
The
courts in Mumbai will be the appropriate authorities for
settlement of all disputes relating to the GreatJob.
However, all parties will endeavor to first resolve the
dispute amicably through mutual consultation, failing
which through arbitration as per the provisions of
Arbitration & Conciliation Act, 1996.
Right
to amend GreatJob from time to time:
Opal
reserves the right, without assigning any reasons, to
vary, modify, amend, alter, restrict any or all provisions
of the GreatJob and to reintroduce the same with or
without such amendments or modifications as it deems fit.
